2. OBJECT AND SCOPE OF APPLICATION
These Conditions regulate the purchase of products through www.miphai.com. By placing an order, you agree to be bound by these Conditions and our Privacy Policy.
3. USE OF THE WEBSITE
The user undertakes to make a lawful use of the website. Placing false or fraudulent orders is prohibited. To place an order, it is necessary for the customer to provide true and accurate contact details.
4. AVAILABILITY OF SERVICE AND PRODUCTS
The items offered are available for shipping to Spain, the European Union, and the rest of the world.
- Products in Stock: Immediate shipping. The estimated delivery date is indicated below the "buy" button.
- Pre-Order: Some of our items are available for pre-order, which means they are currently in production and shipping is not immediate like other orders. The estimated shipping date is visible directly on the product page, just above the "Preorder" button.
5. PURCHASE PROCESS AND FORMALIZATION OF THE CONTRACT
The contract will only be formalized when Miphai sends the order shipping confirmation. Miphai reserves the right to withdraw any product or modify content at any time.
6. PRICES AND PAYMENTS
Prices include VAT (where applicable) and exclude shipping costs.
- Payment Methods: Card (Visa, MasterCard, Amex), PayPal, Apple Pay, Google Pay, and split payment with Klarna.
- Security: Payments are processed in an encrypted manner under bank security protocols.

8. EXCHANGE AND RETURN POLICY
You have 14 calendar days from the receipt of your order to request an exchange or return through our official portal managed by Reveni: https://returns.reveni.io/miphai
8.1 Product Conditions
For the return to be accepted, the garment must be:
- In perfect condition, unused, and with original tags.
- With the security seal intact (if applicable).
- Health and hygiene exception: Exchanges or returns of earrings are not allowed.
8.2 Management of Exchanges
- Instant Exchange: Instant exchange is our way of making your shopping experience as simple and agile as possible. If you need to change your size or color, you don't have to wait to return your order to receive the new one: we process the shipment of the replacement item immediately, without waiting or complications.
- First Size Exchange: Free in Spain and Portugal (Peninsula). Subsequent exchanges or for a different model will incur an associated cost.

8.3 Management of Returns and Refunds

- Return to Physical Stores: You can make a free return at our Miphai stores in Madrid (Claudio Coello 88), Barcelona (Valencia 264), Seville (Cuna 16), Valencia (Jorge Juan 32), Bilbao (Máximo Aguirre 24). Returns are not accepted at El Corte Inglés corners, nor are physical store returns accepted for purchases made at El Corte Inglés.

Refund: It will be made using the same payment method within 1 to 2 days after validation at the central warehouse.
Orders paid fully or partially using a gift card will be refunded using the same payment method. In the event of a return, the amount originally paid with a gift card will be refunded to a new Miphai gift card. Any balance paid using a gift card cannot be refunded or transferred to other payment methods. If the order was paid using multiple payment methods, the refund will be issued in the same proportion used for the purchase (for example, part to the gift card and part to the additional payment method used).
- Out of Timeframe: If the customer sends a product outside the allowed timeframe, we will keep it stored for 15 calendar days; once this time has elapsed, the product cannot be recovered.
8.4 Customs and Duties
Follow return instructions exactly to avoid potential charges: Miphai will not be responsible for customs expenses if the indications sent in emails subsequent to the return request are not followed.
If the customer refuses delivery of the order, they will fully assume any costs derived from the return of the package, including shipping costs, customs fees, duties, import taxes, or other applicable charges. These amounts will be deducted from the refund once the product is received and verified at our facilities.

In international shipments or to territories with a special tax or customs regime (such as the Canary Islands, Ceuta, or Melilla), duties, taxes, customs management fees, or import charges included in the order price correspond exclusively to the clearance process at destination and are non-refundable in case of return, as they are charges liquidated before the competent customs or tax authorities.
For orders shipped outside the European Union, we recommend carefully checking the size guide before purchasing. Due to logistical and customs costs associated with international shipments, once a size or model exchange has been made, no subsequent returns of the replaced product will be accepted.

9. LEGAL WARRANTY AND DEFECTS
In the event of a defective product, the customer must notify it through the returns portal by attaching images within the legal timeframe for return requests (14 calendar days from the delivery date).
10. LIABILITY AND EXONERATION
Miphai will not be held responsible for delays due to force majeure or transport incidents beyond its direct management.
11. INTELLECTUAL PROPERTY
All designs, photographs, logos, and contents of this website are the exclusive property of MIPHAI COLLECTION S.L. Any reproduction or copying without express authorization is prohibited.
12. DATA PROTECTION (GDPR)
Personal data will be treated in accordance with Regulation (EU) 2016/679 to manage your orders and commercial communications. You can exercise your rights of access, rectification, or deletion by sending an email to info@miphai.com.
13. LEGISLATION AND JURISDICTION
These conditions are governed by Spanish law. In the event of a dispute, the parties submit to the jurisdiction of the courts and tribunals of Málaga, Spain.
